Protect Yourself When Transferring a Vehicle in Ontario

Transferring ownership of a vehicle can be a complicated process, but it's important to make sure you follow all the rules to protect yourself. Whether you're buying or selling a car, motorcycle, or any other vehicle, having a contract that's been signed and solemnized by a notary public is the best way to ensure that both parties are protected. This is especially important if you want to avoid any legal issues down the line.

Inter-Family Transfer

When transferring a vehicle to a family member, there is less paperwork involved compared to transferring to a non-family member. However, there are still certain requirements that must be met. According to the Ontario government, family members include spouses, parents, grandparents, children, grandchildren, in-laws, siblings, and adopted siblings.

To transfer ownership to a family member, both parties must visit a Service Ontario location with proof of Ontario car insurance, an Ontario Driver's Licence, a Vehicle Ownership Permit, and other required documents. A spousal declaration may also be needed and must be notarized.

Non-Family Transfer

Selling or transferring a vehicle to a non-family member can be more complex and carries more risk. To transfer a vehicle in Ontario, it's important to make sure the Vehicle Identification Number on the vehicle matches the one on your ownership permit.

If you're selling a vehicle, you'll need to provide the buyer with a Used Vehicle Information Package, a signed Bill of Sale that includes your name, the buyer's name and address, the date, and the purchase price, and other required documents. Royal Seal Notary Public in Oshawa can help you draft a Bill of Sale if needed.

When purchasing a vehicle, there are several steps you should take to ensure the vehicle is properly registered in your name. Check the vehicle's history, emissions testing, and make sure the seller is the legally registered owner. You should also inspect the vehicle thoroughly before making the purchase.

Once the vehicle has been purchased, it must be registered within 6 days. You'll need to bring proof of insurance, your Ontario Driver's Licence, the Bill of Sale, the owner's permit, and other required documents to a Service Ontario kiosk.

At various points throughout the vehicle transfer process, it's advisable to have a notary witness signatures and confirm identity. Royal Seal Notary Public in Oshawa can help provide certainty and peace of mind by notarizing your signatures and verifying your identity.
